SUMMARY:

The gloss concerns the issue of res judicata in proceedings concerning another (new) complaint about the length of proceedings. The author presents the view that in the current legal situation, the court hearing such a complaint is entitled to make an assessment covering the total time of the proceedings from its initiation to the moment the complaint is examined, which means that res judicata does not exist in this respect. However, it is not permissible to verify a judgment issued subsequent to the examination of a previous complaint.
