SUMMARY: The article presents the issue of social security, both on the basis of national, as well as international and EU regulations. It was pointed out that due to the fact that the constitution does not indicate the scope and form of the right to social security, it can be assumed that it also covers new methods of legal protection mitigating the effects of social risks (e.g. funded pension schemes). At the same time, it was pointed out that the legislator’s freedom in shaping the content of social rights is subject to significant restrictions, despite the fact that the legislator left freedom in this respect to the legislator who is to define the elements of the right to social security. Considerations in the national, international and EU aspects were supported by case law.
