Andrzeja Frycza Modrzewskiego, ORCID 0000-0003-3834-221X, sędzia Sądu Rejonowego Katowice-Wschód w Katowicach DOI: 10.53024/8.4.44.2021 URL: https://www.kssip.gov.pl/pobierz_plik/08_pawlik.pdf SUMMARY: The commented judgment concerns a problem that appeared in the practice of the judiciary some time ago and, as it might seem, has already found its solution in the resolution of the Supreme Court (7 judges) of October 30, 2008 (I KZP 20/08), in which it was recognized, that the motor vehicle is the object of an action of the offense specified in art. 178a § 1 of the Criminal Code, so it does not belong to the category of items that are used or intended, within the meaning of Art. 44 § 2 of the Criminal Code, to commit this crime. This view was also shared in later judgments of the Supreme Court. The above-mentioned judgement was widely commented, a number of arguments of a different nature were raised, supporting both the acceptance of the thesis represented by the Supreme Court and opposing the view expressed in it. In this gloss, an attempt was made to discuss the judgment of the Supreme Court of October 3, 2019, in the case II KK 91/19, in which the Supreme Court shared the view expressed in the above – mentioned judgement in the case I KZP 20/08 from the perspective of the current and proposed legal status, doctrine views, and also taking into account the issues of comparative law.
