The journalistic secret – selected issues from the editor-in-chief’s perspective

SUMMARY:

Editor-in-chief – pursuant to Art. 16 sec. 3 of the Press Law – should be informed, within the necessary limits, about matters related to the professional secrecy of a journalist, and may disclose information or other material entrusted to it only under strictly defined conditions. Undoubtedly, such a structure of the provision may pose many difficulties in interpretation in practice, due to the two indefinite terms: “Necessary boundaries”, “matters related to secrecy”. This, in turn, means that it is not an obvious task to determine the specific content of the journalist’s information obligation. The author therefore interprets the cited provision and indicates when the journalist’s obligation may be updated. In addition, the author analyses the functioning of the obligation under Art. 16 sec. 3 of the Press Law, its scope, admissibility and evaluation. In the further part of the article, the positions of journalists in the area of the discussed issues and their interpretation of the scope and limits of the obligation to inform the editor-in-chief are presented. The analysis of the indicated issues was preceded by an indication of the status of the editor-in-chief in the perspective of Art. 7 sec. 2 points 6 and 7 and Art. 25 sec. 1 of the Press Law. The author also addresses the problem of the professional secrecy of journalists, which appears to be one of the fundamental factors for the functioning of an independent press that uses freedom of expression and fulfils its mission.
