SUMMARY:
The author of an article carries out a comprehensive presentation of the consequences of the exercise of the right of silence by the accused in a criminal proceedings. The considerations include the impact of the accused's silence on the assessment of the collected evidence and the overall circumstances of the case, taking into account the rudimentary principles of the criminal proceedings. In this regard, an attempt is made to determine whether silence can be taken into account in the process of proof and constitute the starting point for further decisions - including the decision on the subject of the trial. The impact of the exercise of the right to remain silent by the accused on the procedural situation of the accused is also presented in the context of the admissibility of the institution of sentencing without a hearing and the institution of extraordinary mitigation of punishment.
