Genocide and state immunity. The evolution of American court decisions in civil cases filed against foreign states for the crime of genocide

SUMMARY:

The article aims to determine whether (and if so, to what extent) the practice of American courts in civil cases filed against foreign states for the crime of genocide carried out by their agencies may help crystallise a general rule in international law that would allow domestic courts to refuse immunity to the respondent state whenever the plaintiffs’ case concerns events specified in Article 2 of the Convention of 1948. The reflections that follow are divided into three sections. Part I outlines the most important stages in the historical development of the institution of state immunity. Part II discusses the provisions of the FSIA and the judicial decisions of US courts in civil cases filed against foreign states by genocide victims up until the end of the last decade. Finally, Part III is devoted to new trends in American judicial decisions in such disputes. The article ends with the conclusion that the American context and the current state of international law warrant a negative answer to the above research question.
