SUMMARY

The gloss concerns the issue of imposing penal measures (as well as forfeiture or compensatory measures) in the writ of payment proceedings. Art. 502 § 2 of the CCP stipulates that, in addition to the penalty imposed in the penalty order (restriction of liberty or a fine of up to 200 daily rates or PLN 200,000), it is possible, in the cases provided for in the Act, to order a penalty, forfeiture or compensation measure. In the author’s opinion, however, this does not mean that the legislator introduced an optional possibility of imposing penal measures (as well as forfeiture or compensatory measures) in a prescriptive judgment, in the sense that in the event that the law provides for an obligatory imposition of a penal measure (as well as forfeiture or compensation measure) the court in the writ of payment proceedings is not obliged to do so. The author shares the view expressed by the Supreme Court in the voted judgment that the ruling of a penal measure (as well as forfeiture or compensation measure) is obligatory if the law so provides. This, however, does not result from the case law of the Supreme Court, but from the act, as Art. 502 § 2 of the CCP is of a procedural nature, therefore it is not a substantive law and it does not modify the rules of adjudicating penal measures.
