SUMMARY: The article contains an analysis of the wording of Art. 12 § 3 of the Criminal Procedure Code, in force since 5 October 2019, as a result of the Act of 19 July 2019 amending the Act – Criminal Procedure Code and Certain Other Acts. In accordance with the new wording of the provision, the period to withdraw a motion for prosecution was extended, thus giving an opportunity for persons entitled to make a relevant statement until the proceedings are closed at the first instance initial trial; additionally, a solution was introduced, that in cases when the indictment, is presented by a public prosecutor, the withdrawal of the objection after court proceedings have been initiated is effective if it was not opposed by a public prosecutor present at the trial or hearing. Thus, the legislator introduced to the procedural law system an institution of objection by the public prosecutor to withdrawal of a motion for prosecution. The article puts stress on the essence and legal nature of the institution, as well as on its practical effects.
