The webinar concentrate the attention to the use of the AI systems in the field of justice. In particular, the following themes will be addressed, the subject of access to justice and of the so-called prediction technology or predictive justice, a way of applying the law exploiting the artificial intelligence, with the purpose of predicting the jurisdictional decisions by means of algorithms "trained" in the analysis of databases containing precedents and other useful information to increase the degree of legal certainty and the quality of the decisions. The seminar aims to address the use of artificial intelligence in judicial decision-making to enable a debate on the limits and opportunities of predictive justice in civil and criminal law. Many questions arise in this field. In particular, by focusing on current and planned future developments at European and national level, will be examined some crucial aspects of jurisdiction and the rule of law. Among the issues we can mention: - AI as an instrument for assessing how judge's do justice. - Algorithms as instruments and initiatives - eventually already implemented - of automatization for assisting in standard proceedings. - AI instruments for fastening and helping judges. - Constitutional issues. - The uses of AI in the judicial system for purposes other than predictive justice, supporting the judge's activity, organising the judge's activity, producing the judicial decision as example.
Learning objectives:
The presentation aims to inform participants about the specific difficulties that the use of artificial intelligence creates in the field of justice. Alongside the cognitive aspect, the presentation is intended to encourage discussion on the usefulness and difficulty profiles that these tools encounter in the process of judicial decision-making, given the specific relevance of the protection of fundamental rights in jurisdiction and respect to the rule of law.

The rapid development of narrow artificial intelligence (ANI) disrupts all spheres of human life, provides exceptional opportunities, but also presents unprecedented challenges to crime prevention, prosecution and punishment. The webinar will answer the questions of how the nature of the crime and the essence of crime prosecution and punishment will change, and how it will become increasingly difficult legislation in criminal law to be created and functions precisely because of the impact of ANI and digital technologies. Szczegółowe informacje znajdują się na stronie internetowej EJTN: The presentation will focus on the new business models that have emerged due to the digitalization and globalisation of the economy and will explore the tax issues that arise from this shift. The topic will cover two areas:
First, the importance of the exchange of information and the increasing tax compliance burden that is imposed on online businesses to provide information to the tax authorities. The recent amendments to the mutual assistance directive (DAC7 and DAC8) will be critically presented, as well as recent and pending cases of the Court of justice on the relevant issues.
Secondly, the income tax issues that arise from the delocalization of business. The adoption of digital services taxes around the world is creating uncertainty. It is expected that disputes will arise regarding the compatibility of such taxes with EU law and from the interaction of digital services taxes with bilateral double tax treaties. |
