SUMMARY:
The issue discussed in the commentary includes the exclusion of criminal liability for fraud in
a situation where the other party to a commercial transaction is aware of the difficulties in paying for the goods sold and nevertheless decides to enter into such a risky transaction. Criminal law establishes a penalty only when the other party to a commercial contract concealed its poor financial condition, thereby leading the unaware contractor to an unfavorable financial situation. The crime of fraud can only be considered when the person who disposes of the property does so only because he was misled. The judgment indicates that awareness of the difficulties in obtaining payment and despite this, continuing the delivery of goods, excludes the possibility of attributing fraud. Doing so is within the bounds of conscious risk.
