SUMMARY:
The subject of the commentary is the Supreme Court judgment concerning the conviction of the accused in two separate judgments, in a situation where the acts charged against him constitute in fact one conduct within the framework of an actual concurrence of offences. On the basis of the Petty Offences Code, unlike in criminal law, in art. 9 § 1 of the Petty Offences Code, the legislator adopted the construction of an eliminatory concurrence of provisions, within the framework of which the fulfilment of the features of a more severely punished offence absorbs the fact of committing less severely punished offences. In such a case, a conviction for a fragment of this conduct in another proceeding is excluded, even in the event of a motion for punishment filed by another public prosecutor.
