The issue of halving of the selected types of criminal acts against property

SUMMARY:
This article analyses selected types of criminal acts against property, i.e., theft of an electronic payment instrument, particularly audacious larceny and fraud, from the point of view of the legitimacy of not halving them on the basis of the value of the subject matter of an executory act – as is the case, for example, with so-called ordinary theft. The author takes the position that this kind of differentiation, both for systemic and constitutional reasons, does not find wider justification. In the context of the above considerations, recent amendments to the Criminal Code and the Petty Offence Code are also taken into account.
